TERMS & CONDITIONS — Formateur Elite Inc. (Elite Trainr) (v1.2)

1. Acceptance of Terms

By accessing or using the Elite Trainr mobile application, web platform, or associated services (“Elite Trainr” or “the Platform”), you agree to be bound by these Terms & Conditions (“Terms”).
If you do not agree, do not use the Platform.

These Terms apply to:

  • Trainers
  • Clients
  • Any user who creates an account or accesses Elite Trainr

Elite Trainr is owned and operated by:
Formateur Elite Inc., Quebec, Canada.

2. Eligibility

You must be at least 18 years old to create an account.
Users under 18 must have parental or guardian consent.

3. Health & Medical Disclaimer (Strongest Version)

Elite Trainr is not a medical organization and does not provide medical advice, diagnosis, treatment, or any form of individualized medical supervision.

By using Elite Trainr, you agree that:

  • All exercise, nutrition, and supplement information is general guidance only.
  • You must consult a licensed medical provider before starting any exercise, diet, or supplement protocol.
  • You acknowledge that exercise carries inherent risks, including injury or death.
  • Elite Trainr is not responsible for injuries, side effects, medical complications, or health outcomes resulting from training, nutrition, or supplement recommendations created by trainers or entered into the app.

You participate in all physical activities at your own risk.

Elite Trainr does not guarantee any fitness results or changes in physical condition.

4. Platform Role & Trainer-Client Relationship

Elite Trainr is a software tool that allows trainers and clients to organize coaching, communication, and progress tracking.

  • Elite Trainr does not employ trainers.
  • Elite Trainr does not supervise, certify, or verify trainer qualifications.
  • Elite Trainr does not participate in trainer-client coaching agreements.
  • All training, nutrition, and supplement protocols are independently created by trainers, not by Elite Trainr.
  • Elite Trainr is not responsible for trainer behavior, professionalism, or communication.

5. Payments, Stripe Integration & Financial Disclaimer

Elite Trainr allows trainers to integrate Stripe to collect payments from their clients.

You acknowledge that:

  • Elite Trainr does not handle, process, or store payment information.
  • Elite Trainr does not charge fees or take commissions from trainer-client payments.
  • Trainers are responsible for their own Stripe account, pricing, refunds, taxes, and compliance.
  • Any dispute between a trainer and client is strictly between them.

Elite Trainr has no financial liability for trainer-client transactions.

6. Subscription Fees & In-App Purchases to Elite Trainr

Elite Trainr charges subscription fees and in-app purchase fees for access to certain Platform features.

These fees may be paid by:

  • Trainers, for Elite Trainr platform subscription plans and add-ons
  • Clients, when upgrading directly within the app to Premium Tracking or other Elite Trainr features offered by the Platform

Elite Trainr processes these payments directly for Platform access and feature upgrades only. These payments are separate and distinct from any trainer-client coaching fees.

No Refund Policy

All payments made to Elite Trainr are final, non-refundable, and non-transferable, including but not limited to:

  • Trainer subscription plans (monthly or annual)
  • Client-paid Premium Tracking upgrades
  • Add-ons or feature upgrades
  • Plan changes, upgrades, or downgrades
  • Partial billing periods
  • Unused time or inactivity
  • Dissatisfaction with results, progress, or outcomes
  • Technical issues outside Elite Trainr’s reasonable control

By completing a payment, you expressly acknowledge and agree that no refunds, credits, or chargebacks will be issued under any circumstances, to the maximum extent permitted by law.

You may cancel future renewals at any time through the Platform; however, all charges already processed remain final.

Elite Trainr does not guarantee results, outcomes, usage frequency, or financial success from use of the Platform or its features.

7. User Conduct & Responsibilities

Users agree to:

  • Provide accurate registration information
  • Use the platform lawfully
  • Not harass or exploit other users
  • Not share or upload illegal or harmful content
  • Not attempt to hack, manipulate, or reverse-engineer the app

Elite Trainr may suspend or terminate accounts for violations.

8. Intellectual Property

All designs, features, dashboards, systems, code, branding, algorithms, and related IP belong exclusively to Formateur Elite Inc.

Trainers retain ownership of content they upload (programs, meal plans, check-ins), but grant Elite Trainr a license to display it within the app for operational usage.

Users may not copy, reproduce, or resell platform content.

9. Privacy

Elite Trainr collects and processes user data in accordance with the Elite Trainr Privacy Policy, which forms part of these Terms.

10. Limitation of Liability

To the fullest extent permitted by law:

  • Elite Trainr, Formateur Elite Inc., and its directors, officers, employees, and agents are not liable for injuries, damages, losses, or claims arising from exercise, coaching, nutrition plans, supplement use, or trainer misconduct.
  • Elite Trainr is not responsible for service interruptions, data loss, or technical failures.
  • Maximum liability shall not exceed the amount paid to Elite Trainr in the previous 30 days.

11. Account Termination

Elite Trainr may suspend or terminate accounts for:

  • Violating these Terms
  • Abusive behavior
  • Illegal activity
  • Payment issues
  • Misuse of the platform

Users may cancel subscriptions at any time through the Platform.

12. Governing Law

These Terms are governed by the laws of Quebec, Canada.
